Miscellaneous ACA Litigation

Miscellaneous ACA Litigation

There’s a lot here.  Some cases I’m tracking in some detail, some cases I’m tracking pretty loosely.  Also, here’s an explanation of which cases might be here but are instead on a different sub-page, including the closed-cases subpage.

Cases that are here: Texas v. U.S. originally No. 7:15-cv-151 (N.D. Tex.) (Medicaid managed care plan fees);

American Hospital Ass’n v. Azar, originally No. 1:19-cv-3619 (D. D.C.) (hospital price disclosure);

Chamber of Commerce of the U.S. v. U.S. D.H.H.S., No. 6:21-cv-309 (E.D. Tex.) (transparency regulation);

American Hospital Ass’n v. Azar, originally No. 1:18-cv-2084 (D. D.C.) (drug pricing under 340B);

American Hospital Ass’n v. Azar, No. 1:18-cv-2841 (D. D.C.) (reimbursement rates for hospital outpatient clinics);

Fisher v. Aetna Life Ins. Co., No. 1:16-cv-144 (N.D. Ga.) (family annual limit vs.  individual annual limit);

D.C./Bread for the City v. U.S.D.A., No. 1:20-cv-119 (D. D.C.) (SNAP);

City of Seattle v. Trump, No. 2:20-cv-1560 (W.D. Wash.) (the Anarchist Jurisdictions funding cutoff case);

Coney Island Prep v. U.S. D.H.H.S. and CDC, No. 1:20-cv-9144 (S.D. N.Y.) (HHS and the CDC not living up to statutory reporting responsibilities); and

Oscar Insurance Co. v. Blue Cross and Blue Shield of Florida, No. 19-14096 (11th Cir.), an antitrust case involving the McCarran-Ferguson exception, argued November 20, 2020.

Some materials on the sunset rule case, No. 5:21-cv-1655 (N.D. Cal.).

Texas Medical Association v. U.S. D.H.H.S., No. 6:21-cv-425 (E.D. Tex.), an attack on the regulations implementing the No Surprises Act — ongoing cases separately listed on the No Surprises Act page.

Colville v. Becerra, No. 1:22-cv-113 (S.D. Miss.), an attack on anti-racism plans.

NAGE v. Yellen, No. 1:23-cv-11001 (D. Mass.), a debt ceiling case.

Merck v. Becerra, No. 1:23-cv-1615 (D. D.C.), a Medicare drug pricing case.

Some cases probably properly labeled “miscellaneous” are on the statutory conscience protections page, namely the Skyline Wesleyan, Foothill Baptist, and Vita Nuova cases, collected at https://affordablecareactlitigation.com/statutory-conscience-rights/; also on that page is a health care sharing ministries case from Washington State.

The City of Chicago case on the Trump Administration’s 2020 refusal to hold a special enrollment period is on the special enrollment period page, https://affordablecareactlitigation.com/special-enrollment-periods/.

If there’s any litigation about the Medicaid maintenance of effort requirement, sec. 6008 of the Families First Coronavirus Response Act, I’ll put it on the https://affordablecareactlitigation.com/aca-litigation-state-by-state/ page, where there is already a collection of materials about sec. 6008.

On the closed cases page, https://affordablecareactlitigation.com/closed-aca-cases/, there are now a number of cases that formerly were “miscellaneous.”

[Bench trial, 11/28]

[Reschedule:

1. A Final Pretrial Conference shall be held telephonically on January 17, 2024,
at 9:30 a.m. Dial-in information will be disseminated by email to the parties’
counsel. At the hearing, the Court plans to address the parties’ motions to
exclude, objections to evidence, and pre-mark and pre-admit exhibits. Prior
to the pretrial conference, the parties should confer and attempt to agree to
the admissibility of exhibits where possible.
2. Trial shall begin on January 22, 2024, at 9:00 a.m. in the United States
District Court, Courtroom C-216, 1205 Texas Avenue, Lubbock, Texas.
3. The plaintiff shall make the four witnesses listed on its witness list (Dkt. No.
82) available for the defendants to depose by December 22, 2023. Given the
limited scope of the plaintiff’s proposed declarations, each deposition is
limited to no more than four hours.
4. The defendants shall file any motion to exclude the plaintiff’s witnesses by
December 29, 2023. The plaintiff shall file any response by January 10, 2024.
5. All other deadlines from the Court’s prior scheduling Order (Dkt. No. 75)
remain unchanged.

01/17/2024 104  ELECTRONIC Minute Entry for proceedings held before Judge James Wesley Hendrix: Final Pretrial TeleConference held on 1/17/2024. The Court discussed procedural matters and the parties evidentiary objections. Regarding the parties to this case, the parties agreed that defendants Secretary Alejandro Mayorkas and Administrator Deanne Criswell are sued in their official capacities and that defendant U.S. Customs and Border Enforcement is dismissed as a non-existent agency. For trial, argument will be bifurcated between (1) jurisdictional matters (standing and other justiciability doctrines); and (2) the merits and remedies. Each side shall have one hour for each portion of the argument, for a total of two hours per side. As for the parties evidentiary disputes, the Court overruled the defendants objections to plaintiffs exhibits 1, 2, 3, 4, 11, and 13, and sustained the defendants hearsay objections to plaintiffs exhibits 9, 10, and 12. The Court overruled the plaintiffs objections to defendants exhibits 2, 5, 6, 7, 8, 11, and 15. The plaintiff withdrew its objections to defendants exhibit 4, and the defendant withdrew its exhibit 3 and paragraphs 23 through 30 of exhibit 15. There were no objections to plaintiffs exhibits 5 through 8 or defendants exhibits 1, 9, 10, 12 through 14, and 16 through 40. Consistent with the foregoing, the Court denies the defendants motion in limine (Dkt. No. 77), grants in part and denies in part the defendants objections (Dkt. No. 92), and denies the plaintiffs objections (Dkt. No. 78) and motion to exclude (Dkt. No. 93) in part on the merits and in part as moot. Based on these rulings, the Court preadmitted plaintiffs exhibits 1 through 8, 11, and 13, and defendants exhibits 1, 2, 4 through 14, and 16 through 40 in full and defendants exhibit 15 excluding paragraphs 23 through 30. Attorney Appearances: Plaintiff – Ethan Szumanski/Susanna Dokupil, Matthew Miller/Nathan Curtisi, Robert Henneke; Defense – Michael Gaffney/Clayton Bailey. (Court Reporter: Mechelle Daniel) (Exhibits preadmitted – returned to parties) Time in Court – 2:15. (chmb) (Entered: 01/17/2024)
