[Reschedule:
1. A Final Pretrial Conference shall be held telephonically on January 17, 2024,
at 9:30 a.m. Dial-in information will be disseminated by email to the parties’
counsel. At the hearing, the Court plans to address the parties’ motions to
exclude, objections to evidence, and pre-mark and pre-admit exhibits. Prior
to the pretrial conference, the parties should confer and attempt to agree to
the admissibility of exhibits where possible.
2. Trial shall begin on January 22, 2024, at 9:00 a.m. in the United States
District Court, Courtroom C-216, 1205 Texas Avenue, Lubbock, Texas.
3. The plaintiff shall make the four witnesses listed on its witness list (Dkt. No.
82) available for the defendants to depose by December 22, 2023. Given the
limited scope of the plaintiff’s proposed declarations, each deposition is
limited to no more than four hours.
4. The defendants shall file any motion to exclude the plaintiff’s witnesses by
December 29, 2023. The plaintiff shall file any response by January 10, 2024.
5. All other deadlines from the Court’s prior scheduling Order (Dkt. No. 75)
remain unchanged.
01/17/2024 | 104 | ELECTRONIC Minute Entry for proceedings held before Judge James Wesley Hendrix: Final Pretrial TeleConference held on 1/17/2024. The Court discussed procedural matters and the parties evidentiary objections. Regarding the parties to this case, the parties agreed that defendants Secretary Alejandro Mayorkas and Administrator Deanne Criswell are sued in their official capacities and that defendant U.S. Customs and Border Enforcement is dismissed as a non-existent agency. For trial, argument will be bifurcated between (1) jurisdictional matters (standing and other justiciability doctrines); and (2) the merits and remedies. Each side shall have one hour for each portion of the argument, for a total of two hours per side. As for the parties evidentiary disputes, the Court overruled the defendants objections to plaintiffs exhibits 1, 2, 3, 4, 11, and 13, and sustained the defendants hearsay objections to plaintiffs exhibits 9, 10, and 12. The Court overruled the plaintiffs objections to defendants exhibits 2, 5, 6, 7, 8, 11, and 15. The plaintiff withdrew its objections to defendants exhibit 4, and the defendant withdrew its exhibit 3 and paragraphs 23 through 30 of exhibit 15. There were no objections to plaintiffs exhibits 5 through 8 or defendants exhibits 1, 9, 10, 12 through 14, and 16 through 40. Consistent with the foregoing, the Court denies the defendants motion in limine (Dkt. No. 77), grants in part and denies in part the defendants objections (Dkt. No. 92), and denies the plaintiffs objections (Dkt. No. 78) and motion to exclude (Dkt. No. 93) in part on the merits and in part as moot. Based on these rulings, the Court preadmitted plaintiffs exhibits 1 through 8, 11, and 13, and defendants exhibits 1, 2, 4 through 14, and 16 through 40 in full and defendants exhibit 15 excluding paragraphs 23 through 30.
