The scope of the Courts ruling speaks for itself. However, the rationale for the ruling was that the 2020 Rule was promulgated without taking into account the Supreme Courts decision in Bostock v. Clayton County, 140 S. Ct. 1731 (2020), which created a likelihood that the plaintiff would prevail on their claims that the rule was contrary to law and arbitrary and capricious. The Court focused on the impact of the decision on the repeal of the 2016 definition because that was the parties focus; the need for such focus is understandable given the tight timeframe involved and the particularly byzantine nature of the 2020 Rule.It appears that Bostocks interpretation of sex discrimination may have an impact on other aspects of the 2020 Rule. Therefore, the plaintiffs shall, within 7 days of this order, submit a list of the provisions of the 2020 Rule they think should be stayed in light of Bostock. The list should consist of citations to the Code of Federal Regulations (either provisions of the 2020 Rule or provisions of the 2016 Rule to be repealed), not citations to summaries of the proposed regulatory changes in the rules preamble. The petition for a writ of certiorari is granted limited to Question 1 presented by the petition.
QUESTIONS PRESENTED
Section 1557 of the Patient Protection and Affordable Care Act (“ACA”) creates a private right of action for discrimination on the basis of race, sex, age, and disability in federally funded health programs and activities. 42 U.S.C. § 18116(a). This private right of action incorporates the “enforcement mechanisms” of other federal antidiscrimination statutes, including the Rehabilitation Act of 1973, 29 U.S.C. § 794, which prohibits disability discrimination. The questions presented are:
1. Whether section 504 of the Rehabilitation Act, and by extension the ACA, provides a disparate-impact cause of action for plaintiffs alleging disability discrimination.
2. If section 504 and the ACA create disparate-impact claims, whether such claims extend to the facially
neutral terms and conditions of health insurance plans.
